1. INTRODUCTION AND SCOPE

1.1 Food Truck Finder L.L.C. (“Food Truck Finder”, “we”, “us” or “our”) operates a discovery platform that helps people find food trucks and other mobile food businesses, view menus and see live operating locations, and that allows food truck operators to publish a business listing and share their operating position. This Privacy Policy explains what personal information we collect, why we collect it, who we share it with, how long we keep it and what choices and rights you have.

1.2 This Policy applies to the Food Truck Finder mobile applications for iOS and Android, the website at https://www.food-truck-finder.com, the vendor dashboard, and our communications with users and prospective users. It applies to individuals in the United States and Canada, which are the markets in which the Service is offered.

1.3 This Policy does not apply to the practices of food truck operators, mapping and navigation providers, app stores, or any other third party. When you leave the Service, or when you buy food from a vendor in person, that interaction is governed by that party’s own practices.

1.4 In this Policy, “personal information” means information about an identifiable individual, and includes what United States state privacy laws describe as personal data or personal information. Capitalised terms not defined here have the meaning given in our Terms and Conditions at https://www.food-truck-finder.com/legal/terms.

1.5 If you do not agree with this Policy, please do not use the Service.

2. WHO WE ARE AND HOW TO CONTACT US

2.1 Food Truck Finder L.L.C. is the business responsible for the personal information described in this Policy. Our principal place of business is Kent County, Michigan.

2.2 You can reach our privacy team at josh@food-truck-finder.com or by writing to Food Truck Finder L.L.C., 2878 Valley Spring Ln SE, Caledonia, MI, 49316, marked for the attention of the Privacy Officer.

2.3 We have designated a person responsible for the protection of personal information, as required for organisations handling the personal information of individuals in Quebec. That person may be contacted at josh@food-truck-finder.com.

2.4 We aim to acknowledge privacy enquiries within five business days and to respond substantively within the period required by the law applicable to you, as described in sections 20 and 21.

3. PERSONAL INFORMATION YOU PROVIDE TO US

3.1 Account information. When you create a consumer account we collect your name or chosen display name, email address, password in hashed form, and any profile photograph you choose to upload. Where you register using a third party sign in service, we receive the identifiers and basic profile information that service releases to us in accordance with your settings with that service.

3.2 Vendor account and listing information. When you register a vendor account we collect the business name, trading names, business contact name, email address, telephone number, cuisine categories, business description, logo and photographs, menu items with descriptions and prices, operating hours, planned schedule, service area and, where you provide them, business licence, permit or registration details and social media handles. Much of this information is intended for publication.

3.3 User content. We collect star ratings, written reviews, photographs, vendor responses to reviews, saved favourites, reports of inappropriate content and any other material you submit.

3.4 Communications. When you contact support, complete a contact form, request a demo or respond to a survey, we collect the content of your message and any information you include in it.

3.5 Preferences. We collect your notification preferences, saved searches, cuisine filters, language preference and marketing choices.

3.6 Payment information. As at the Effective Date the Service is free to use and we do not collect payment card details. If we introduce paid features, payment card details will be collected and processed by a payment processor and we will update this Policy before doing so.

4. INFORMATION COLLECTED AUTOMATICALLY FROM YOUR DEVICE

4.1 Device and application information. We collect the device model, operating system and version, application version, device language and region settings, time zone, mobile network information, device identifiers such as the Identifier for Advertisers on iOS or the Advertising ID on Android where you permit their use, and a resettable installation identifier.

4.2 Usage information. We collect information about how you interact with the Service, including the screens you view, searches you run, filters you apply, vendors you view or save, links you follow, session start and end times, referral source and interaction timestamps.

4.3 Log and technical information. Our servers automatically record internet protocol address, request headers, browser type and version for web access, pages requested, response codes, error and crash reports, and diagnostic data.

4.4 Approximate location derived from network information. Even where you decline precise location permission, an internet protocol address may indicate an approximate location such as a city or region, and we may use that to show broadly relevant results.

4.5 Vendor analytics. For vendor accounts we generate aggregated engagement metrics, including profile views, saves, review counts, average rating and trends over time. These metrics are derived from consumer activity and are presented to vendors in aggregate rather than as information about identifiable individuals.

5. LOCATION INFORMATION AND PRECISE GEOLOCATION

5.1 Location is central to the Service. With your permission, the mobile application collects the precise location of your device in order to show nearby vendors, sort and filter results by distance, provide directions and deliver notifications about vendors near you.

5.2 We ask for location permission through the operating system. On iOS you may choose to allow precise or approximate location, to allow location once, to allow it while using the application, or to deny it. On Android you may choose approximate or precise location and may allow it while the application is in use. You can change or withdraw these permissions at any time in your device settings, and you can use the Service by searching for a city or address instead.

5.3 We do not collect the location of consumer devices in the background when the application is not in use, and we do not track the continuous movements of consumer users.

5.4 Vendor location. When a vendor enables location sharing, the position of the mobile food unit is collected while sharing is switched on and is published to consumer users on the live map. Vendor location is business operating information that the vendor chooses to publish, and vendors may switch sharing off at any time.

5.5 Several United States state privacy laws treat precise geolocation as sensitive personal information, and Quebec’s privacy legislation requires consent that is manifest, free and informed, given separately, for the activation of technology allowing a person to be located. We ask for your consent before collecting precise geolocation, we use it only for the purposes described in this section and in section 9, and we do not use it for advertising purposes.

5.6 We retain precise location data associated with a consumer device only for as long as needed to serve your request and to detect abuse, as described in section 16. Location history is not published to other users and is not made available to vendors in identifiable form.

6. INFORMATION WE RECEIVE FROM THIRD PARTIES

6.1 App stores. Apple and Google provide us with limited information about downloads, installations, application version and, where applicable, subscription status. They do not provide us with your payment card details.

6.2 Identity providers. If you sign in through a third party service, we receive the profile fields that service releases based on your permissions.

6.3 Analytics, crash reporting and infrastructure providers. These providers supply us with technical and usage information about the operation of the Service.

6.4 Public and business sources. When building or verifying vendor listings, we may receive information from a vendor’s own website or public social media presence, from event organisers, and from publicly available business registers. Where we create a preliminary listing from public sources, we will identify it as unclaimed and the operator may claim, correct or request removal of it.

6.5 Other users. Other users may mention you in a review or report content you have submitted.

7. PUBLICLY VISIBLE INFORMATION

7.1 The following information is visible to other users of the Service and, where the Service is publicly accessible, to the general public: your display name and profile photograph, your star ratings and written reviews, any photographs you attach to a review, and the date of your review.

7.2 For vendors, the following information is published: business name, cuisine categories, business description, logo and photographs, menus and prices, operating hours and planned schedule, live operating location when sharing is enabled, aggregate rating and reviews, responses to reviews, and any contact details or links the vendor chooses to publish.

7.3 Publicly visible information may be indexed by search engines, cached, copied or reposted by others in ways we cannot control. Please consider carefully what you choose to publish.

7.4 You may edit or delete your reviews, and vendors may edit their listings, at any time. Removal from our Service does not remove copies held by third parties.

8. COOKIES, SOFTWARE DEVELOPMENT KITS AND SIMILAR TECHNOLOGIES

8.1 Our website uses cookies and similar technologies, and our mobile applications use software development kits and local storage that perform comparable functions. Full details, including the categories in use and their purposes, are set out in our Cookie Policy at https://www.food-truck-finder.com/legal/cookies.

8.2 Strictly necessary technologies are used to authenticate users, maintain sessions, balance load, remember consent choices and protect against fraud and abuse. These are used without consent because the Service cannot function without them.

8.3 Functional, analytics and, where used, advertising technologies are deployed only where you have given consent, in jurisdictions where consent is required, and you may withdraw consent at any time through the cookie preference centre on our website or through the privacy settings in the application.

8.4 Quebec’s privacy legislation requires consent for the use of technology that allows a person to be identified, located or profiled, and requires that we inform you of the means available to deactivate such technology. Our cookie banner and preference centre provide those controls to users in Quebec.

8.5 Where a recognised opt out preference signal such as Global Privacy Control is transmitted by your browser, we treat it as a valid opt out request for the browser concerned to the extent required by applicable law.

8.6 You may also limit the use of mobile advertising identifiers through your device settings, and may reset those identifiers at any time.

9. HOW WE USE PERSONAL INFORMATION

9.1 To provide the Service, including creating and maintaining your account, displaying nearby vendors, delivering search results, showing menus and live locations, enabling saved favourites, publishing reviews and providing directions.

9.2 To operate vendor tools, including publishing listings, enabling location sharing, delivering specials to followers and generating aggregate engagement analytics for vendors.

9.3 To communicate with you, including sending service and security messages, responding to support requests, and, where permitted, sending push notifications and marketing communications in accordance with section 14.

9.4 To maintain the integrity of ratings and reviews, including detecting duplicate accounts, incentivised or fabricated reviews, review manipulation and undisclosed insider reviews.

9.5 To secure the Service, including authenticating users, detecting and investigating fraud, abuse, scraping and unauthorised access, and enforcing our Terms and Conditions and Community and Review Guidelines.

9.6 To measure and improve the Service, including analysing usage patterns, diagnosing errors, testing features and understanding which cities and cuisines to prioritise. Where practicable we use aggregated or de-identified information for this purpose.

9.7 To comply with legal obligations, including responding to lawful requests from public authorities, maintaining records, and establishing, exercising or defending legal claims.

9.8 We do not use personal information for any purpose that is incompatible with the purposes described in this Policy. If we wish to use personal information for a materially different purpose, we will inform you and, where required, obtain your consent.

10.1 In Canada, we collect, use and disclose personal information with your knowledge and consent, except where collection, use or disclosure without consent is permitted or required by law. Consent may be express or implied depending on the sensitivity of the information and the reasonable expectations of the individual.

10.2 We obtain express consent for the collection of precise geolocation, for the use of non-essential tracking technologies, and for commercial electronic messages sent to recipients in Canada.

10.3 You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent for location or notifications will limit the corresponding features. To withdraw consent, use the controls in the Service or contact us at josh@food-truck-finder.com.

10.4 In the United States, we provide notice of our collection and use practices at or before the point of collection, and we obtain consent where state law requires it, including for the processing of sensitive personal information such as precise geolocation and for the personal information of known minors.

10.5 We limit collection to what is necessary for the purposes identified, and we do not make consent to non-essential processing a condition of using core features of the Service.

11. DISCLOSURE OF PERSONAL INFORMATION

11.1 Publicly, as described in section 7, where you choose to publish reviews or a vendor listing.

11.2 To vendors, in the form of published reviews and responses, and in the form of aggregate engagement analytics. We do not give vendors access to the contact details, device identifiers or location history of consumer users.

11.3 To service providers acting on our behalf, as described in section 12.

11.4 To professional advisers, insurers and auditors, where necessary and subject to duties of confidentiality.

11.5 In connection with a corporate transaction, including a merger, acquisition, financing, reorganisation, insolvency or sale of assets, in which case personal information may be transferred as a business asset, subject to the acquirer being bound by commitments no less protective than this Policy. Where required by law, we will notify affected individuals.

11.6 To public authorities, law enforcement, courts or regulators where we are required to do so by law, subpoena, court order or other lawful process, or where disclosure is necessary to investigate suspected illegal activity, to protect the safety of any person, or to establish, exercise or defend legal claims. We assess each request, require lawful authority, and disclose no more than is necessary.

11.7 With your consent or at your direction, for any other purpose disclosed to you at the time.

11.8 We do not disclose personal information to data brokers.

12. SERVICE PROVIDERS AND PROCESSORS

12.1 We engage third parties to perform functions on our behalf, including cloud hosting and storage, content delivery, database and backup services, email delivery, push notification delivery, customer support tooling, product analytics, crash and performance monitoring, mapping and geocoding, fraud and abuse prevention, and, if paid features are introduced, payment processing.

12.2 Service providers are permitted to process personal information only on our documented instructions and only for the purposes of providing their service to us. They are not permitted to use it for their own purposes, to sell it, or to disclose it except as we direct or as required by law.

12.3 We enter into written agreements with service providers that impose confidentiality, security, retention, deletion, subcontracting and assistance obligations consistent with the requirements of the privacy laws applicable to us.

12.4 Before entrusting personal information to a service provider outside Quebec, we conduct the assessment required by applicable Quebec law and put in place a written agreement addressing the protections afforded to the information.

12.5 A current list of the categories of service providers we use, and information about specific providers, is available on request from josh@food-truck-finder.com.

13. SELLING, SHARING AND TARGETED ADVERTISING

13.1 We do not sell personal information in exchange for monetary consideration.

13.2 We do not use or disclose precise geolocation, or any other information we treat as sensitive, for targeted or cross context behavioural advertising.

13.3 If in future we engage in any disclosure of personal information that constitutes a sale, a share for cross context behavioural advertising, or targeted advertising under applicable state privacy law, we will update this Policy, provide the notices required by law, and offer a clear and accessible opt out before doing so.

13.4 We may promote our own Service through advertising on third party platforms. Where this involves the use of hashed contact information to build audiences, we will identify the practice in this Policy and provide an opt out where required.

13.5 We do not knowingly sell or share the personal information of consumers under sixteen years of age.

14. MARKETING COMMUNICATIONS AND PUSH NOTIFICATIONS

14.1 We may send you emails about new features, vendors in your area and other product news where you have opted in or where sending is otherwise permitted by law. Every marketing email contains an unsubscribe link and our postal address, consistent with the CAN-SPAM Act, 15 U.S.C. 7701 and following.

14.2 For recipients in Canada, commercial electronic messages are sent only with express or implied consent as defined in Canada’s Anti-Spam Legislation, S.C. 2010, c. 23, and each message identifies us and contains an unsubscribe mechanism that remains valid for at least sixty days.

14.3 Push notifications are sent only where you have enabled them at the operating system level. You may disable them at any time in your device settings without affecting other features.

14.4 Service and transactional messages relating to your account, security, legal notices and material changes to our terms are not marketing messages and will continue while your account is active.

14.5 Unsubscribing takes effect promptly and in any event within the period required by applicable law.

15. AUTOMATED PROCESSING AND PROFILING

15.1 We use automated processing to rank and sort search results by relevance and distance, to generate recommendations and notifications about vendors you may like, to compute aggregate ratings, and to detect suspected fraudulent accounts, fake reviews and abusive behaviour.

15.2 We do not use automated processing to make decisions that produce legal effects concerning you or that similarly significantly affect you, other than automated detection of suspected abuse, which may result in content being flagged, restricted or removed or an account being suspended.

15.3 Where an automated abuse detection measure affects your account or content, you may request human review by contacting josh@food-truck-finder.com. We will tell you the principal reasons for the measure and the principal factors taken into account, and you may submit observations, consistent with the transparency requirements applicable in Quebec and in United States states that grant a right to appeal or to opt out of certain profiling.

15.4 We do not engage in profiling in furtherance of decisions concerning credit, housing, insurance, employment, education or access to essential goods and services.

16. RETENTION OF PERSONAL INFORMATION

16.1 We keep personal information only for as long as necessary for the purposes for which it was collected, or for such longer period as is required or permitted by law.

16.2 Account information is retained while your account is active and for a period of up to 90 days after deletion, to allow account recovery, to resolve disputes and to prevent the immediate re-registration of accounts removed for abuse. Backups are overwritten on a rolling cycle.

16.3 Reviews and vendor listings may remain published after an account is closed, in de-identified form where we are able to do so, in order to preserve the integrity of aggregate ratings. You may request removal of specific reviews.

16.4 Precise location data associated with a consumer device is retained only for the period necessary to serve your request and for a short period thereafter for security and abuse detection, after which it is deleted or aggregated.

16.5 Support correspondence is retained for a period appropriate to the resolution of the matter and to the defence of legal claims. Records required for tax, accounting or regulatory purposes are retained for the period prescribed by law.

16.6 When the purposes for which personal information was collected have been achieved, we destroy the information or anonymise it in accordance with our retention and destruction schedule.

17. INFORMATION SECURITY

17.1 We implement administrative, technical and physical safeguards designed to protect personal information against loss, theft and unauthorised access, use, disclosure, copying, alteration and destruction, taking into account the sensitivity of the information and the risks presented.

17.2 Those safeguards include encryption of data in transit using current transport layer security, encryption of data at rest in our production databases, role based access control and least privilege, multi factor authentication for administrative access, logging and monitoring, secure development practices, vulnerability management and patching, and periodic review of access rights.

17.3 Access to personal information is limited to personnel and contractors who need it to perform their duties and who are subject to confidentiality obligations and privacy and security training.

17.4 No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for the security of the device on which you use the Service.

17.5 We maintain an incident response process. Where a security incident creates a risk of serious injury or meets the notification threshold under applicable law, we will notify affected individuals and the relevant authorities, including the Office of the Privacy Commissioner of Canada and the Commission d’acces a l’information du Quebec where applicable, within the time required by that law, and we will maintain the records of incidents that the law requires.

18. CROSS BORDER HANDLING OF PERSONAL INFORMATION

18.1 We are based in the United States. Personal information that we collect from users in Canada is processed and stored in the United States and may be processed in other countries where our service providers operate.

18.2 Personal information stored in another country is subject to the laws of that country and may be accessible to courts, law enforcement and national security authorities of that country under lawful process.

18.3 Where we transfer personal information outside Quebec, we carry out the assessment required by applicable Quebec law before doing so and enter into a written agreement addressing the protection of the information.

18.4 For transfers outside Canada more generally, we use contractual and organisational measures designed to provide a comparable level of protection to that which the information receives in Canada, consistent with the accountability principle under the Personal Information Protection and Electronic Documents Act, S.C. 2000, c. 5.

19. CHILDREN’S PRIVACY

19.1 The Service is not directed to children under thirteen, and we do not knowingly collect personal information from children under thirteen. This reflects our obligations under the Children’s Online Privacy Protection Act, 15 U.S.C. 6501 and following, and its implementing rule.

19.2 For users resident in Quebec who are under fourteen, personal information is collected only where consent has been given by a person having parental authority or by the tutor.

19.3 We do not knowingly process the sensitive personal information of a person under eighteen without the consent required by applicable state law, and we do not process the precise geolocation of a person we know to be a child in circumstances where applicable law prohibits it.

19.4 If you are a parent or guardian and believe that a child has provided personal information to us, contact josh@food-truck-finder.com and we will investigate, delete the information and close the account.

19.5 Users in California who are under eighteen and who are registered users may request the removal of content they have posted publicly on the Service, as provided by California Business and Professions Code section 22581. Removal may not be complete or comprehensive where the content has been copied or reposted by others.

20. YOUR PRIVACY RIGHTS IN THE UNITED STATES

20.1 Several United States states have enacted comprehensive privacy laws that grant residents rights in respect of their personal information. Where such a law applies to us and to you, you have the rights described in this section. We do not require you to demonstrate that a particular law applies before we consider your request, and we apply these rights on a consistent basis wherever practicable.

20.2 The right to know what personal information we have collected about you, the categories of sources, the purposes of collection, the categories of third parties to whom it has been disclosed, and to obtain a copy of the personal information you have provided.

20.3 The right to correct inaccurate personal information.

20.4 The right to request deletion of personal information, subject to exceptions permitting us to retain information for security, fraud prevention, legal compliance, the exercise or defence of legal claims and other purposes recognised by law.

20.5 The right to obtain your personal information in a portable and, to the extent technically feasible, readily usable format.

20.6 The right to limit the use and disclosure of sensitive personal information, including precise geolocation, to those uses necessary to provide the Service.

20.7 The right to opt out of the sale of personal information, of sharing for cross context behavioural advertising, and of targeted advertising and certain profiling. As at the Effective Date we do not engage in these activities, as stated in section 13.

20.8 The right not to receive discriminatory treatment for exercising a privacy right. We will not deny you the Service, charge you a different price or provide a different level of quality because you exercised a right.

20.9 The right, where available under the law applicable to you, to appeal a refusal of your request. Appeals may be submitted to josh@food-truck-finder.com and will be determined within the period required by that law. Where an appeal is refused, we will inform you of the mechanism for lodging a complaint with the relevant Attorney General.

21. YOUR PRIVACY RIGHTS IN CANADA

21.1 You have the right to be informed of the existence, use and disclosure of your personal information and to be given access to it.

21.2 You have the right to request correction of personal information that is inaccurate, incomplete or ambiguous, and, in Quebec, to require that the corrected information be communicated to persons who received it in the preceding six months.

21.3 You have the right to withdraw consent, subject to legal or contractual restrictions and reasonable notice.

21.4 Where you are in Quebec, you additionally have the right to receive computerised personal information that you have provided to us in a structured and commonly used technological format, the right to request that the dissemination of your personal information cease or that a hyperlink or index giving access to it be de-indexed where the conditions set out in the applicable legislation are met, and the right to be informed about, and to submit observations on, decisions based exclusively on automated processing.

21.5 Requests should be sent to josh@food-truck-finder.com. We will respond within thirty days of receiving a request, as required by the Personal Information Protection and Electronic Documents Act and by Quebec legislation, and we will explain any refusal and the recourse available to you.

21.6 If you are not satisfied with our response, you may complain to the Office of the Privacy Commissioner of Canada at https://www.priv.gc.ca, and, if you are in Quebec, to the Commission d’acces a l’information du Quebec at https://www.cai.gouv.qc.ca. Residents of Alberta and British Columbia may complain to their provincial Information and Privacy Commissioner.

22. CALIFORNIA SPECIFIC DISCLOSURES

22.1 This section applies to residents of California to the extent that the California Consumer Privacy Act, California Civil Code section 1798.100 and following, applies to our processing of your personal information.

22.2 The categories of personal information we collect are identifiers, internet or other electronic network activity information, precise geolocation, commercial information relating to your use of the Service, audio, electronic or visual information in the form of photographs you upload, and inferences drawn to generate recommendations. The sources, purposes and recipients of each category are described in sections 3 to 12.

22.3 We treat precise geolocation as sensitive personal information and use it only for the purposes set out in section 5. We do not use or disclose sensitive personal information for purposes other than those permitted without an obligation to offer a right to limit.

22.4 We do not sell personal information and do not share personal information for cross context behavioural advertising.

22.5 You may exercise your California rights by contacting josh@food-truck-finder.com. You may use an authorised agent, in which case we will require written authorisation and may require you to verify your identity directly.

22.6 California residents may request information about the disclosure of personal information to third parties for their direct marketing purposes under California Civil Code section 1798.83. We do not make such disclosures.

22.7 We do not currently respond to browser do not track signals in a standardised way, as no common standard has been adopted, but we honour recognised opt out preference signals as described in section 8.5.

23. HOW TO EXERCISE YOUR RIGHTS

23.1 You may exercise rights by emailing josh@food-truck-finder.com with the subject line “Privacy Request”, by using the privacy controls in the Service, or by writing to us at the address in section 2.

23.2 We will take reasonable steps to verify your identity before acting on a request, which may involve confirming control of the email address associated with your account or asking for information already held by us. We will not create new accounts or collect additional identifying information solely for verification unless necessary.

23.3 We will respond within the period required by the law applicable to you, which is generally forty five days in the United States states that grant these rights, extendable where permitted, and thirty days in Canada.

23.4 There is no charge for a request unless it is manifestly unfounded, excessive or repetitive, in which case we may charge a reasonable fee or decline to act, and we will tell you why.

23.5 If we refuse a request in whole or in part, we will explain the reason, identify any exception relied upon and tell you how to challenge the decision.

23.6 If you wish to raise a concern about how we handle personal information, please contact us first at josh@food-truck-finder.com so that we can try to resolve it.

24.1 The Service links to and integrates with third party services, including mapping and navigation applications, app stores, vendor websites and social media pages. Those parties handle personal information in accordance with their own privacy policies, which we encourage you to read.

24.2 When you tap for directions, information necessary to open the route, including the destination and, depending on your settings, your location, is passed to the navigation application on your device.

24.3 We are not responsible for the privacy practices, content or security of third party services, and this Policy does not apply to them.

25. CHANGES TO THIS POLICY, COMPLAINTS AND CONTACT

25.1 We may update this Policy to reflect changes in our practices, in the Service or in applicable law. The Effective Date at the top of this Policy shows when it was last revised, and we maintain the previous version on request.
